Terms of Service

1. Acceptance of Terms

By accessing or using ApplyFast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

ApplyFast is an AI-powered tool that assists users in generating resumes. The Service uses artificial intelligence to produce content suggestions based on user-provided information and job descriptions. The Service is a productivity tool, not a career counseling, employment, or recruiting service.

3. AI-Generated Content Disclaimer

Content generated by the Service is produced by artificial intelligence and is provided "as-is." You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, errors, or omissions.
  • You are solely responsible for reviewing, verifying, and editing all generated content before use.
  • The Service does not guarantee that generated resumes will result in job interviews, offers, or employment.
  • You must ensure all information in your resume is truthful and accurate. Submitting a misleading resume to employers is your responsibility, not ours.
  • We are not liable for any consequences arising from your use of AI-generated content, including but not limited to rejected applications, missed opportunities, or employer decisions.

4. User Accounts & Responsibilities

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the Service.

5. Acceptable Use

You agree not to:

  • Use the Service to generate fraudulent, misleading, or deceptive resumes.
  • Reverse-engineer, scrape, or attempt to extract the underlying AI models or algorithms.
  • Use the Service in any way that violates applicable laws or regulations.
  • Resell, redistribute, or sublicense access to the Service without written consent.
  • Upload content that infringes on third-party intellectual property rights.

6. Intellectual Property & Content Ownership

Your content: You retain ownership of all information you provide (profile data, work history, etc.) and the final resumes you generate. You grant us a limited license to process your content solely to provide the Service.

Our content: The Service, its design, code, branding, and underlying technology are owned by ApplyFast. These Terms do not grant you any rights to our intellectual property beyond using the Service as intended.

7. Subscriptions, Billing & Refunds

Paid plans are billed in advance on a recurring basis. Subscriptions auto-renew unless cancelled before the next billing cycle. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPLYFAST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless ApplyFast and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) the content of resumes you create or distribute using the Service.

11. Termination

We may suspend or terminate your account at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Sections 3, 6, 8, 9, 10, 12, and 13 survive termination.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding individual arbitration, not in court. You waive any right to participate in class actions or class arbitrations. This arbitration agreement is governed by the Federal Arbitration Act. Small claims court actions are exempt from this provision.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
